These terms and conditions apply to all giveaways conducted by us via the Instagram profile under “cardcosmos.de”.
The organizer of the giveaway is cardcosmos GmbH, Bremland 34, 24857 Fahrdorf.
This promotion is not affiliated with Instagram and is in no way sponsored, supported, or organized by Instagram. All information provided in connection with the giveaways is provided exclusively by cardcosmos GmbH as the organizer of the giveaway.
By participating in the giveaway, participants expressly accept these terms and conditions.
Both customers and non-customers of cardcosmos GmbH are eligible to participate.
Employees of cardcosmos GmbH and their relatives are excluded from participation.
The giveaway begins at the respective publication time on our Instagram profile. Participation is only possible until the respective stated drawing time. Please refer to the giveaway information on our Instagram profile in the respective giveaway post for the relevant times.
The exact participation methods are stated in the caption of the respective giveaway post. Participation may, for example, be possible by liking a post, commenting on it, following the profile, sharing the post, or through similar interactions.
The prize is stated in the respective giveaway post. Only non-cash prizes are offered. Payment of the prize value in cash or exchange of the prize is excluded. The right to the prize is not transferable.
The winners are generally determined immediately after the giveaway ends by random draw. In the case of estimation questions, the participants whose answers are closest to the underlying result win. In the event of a tie, the winner among the participants with equal rankings will be determined by drawing lots. The winners will be notified via a personal message on Instagram. Each winner must respond via Instagram message within 4 business days. If no response is received within this period, the right to the prize expires and a new winner will be determined.
The prizes will be delivered by mail and/or collected from a cardcosmos Store. Further details will be communicated in the giveaway post.
For the purpose of conducting the giveaway, cardcosmos GmbH processes participants’ personal data. This may include, in particular, the Instagram username, interactions made publicly as part of participation (e.g. comments), and, for winners, the contact details required for notification and prize delivery.
The processing is carried out exclusively for the purpose of conducting the giveaway, in particular to verify eligibility requirements, determine the winners, notify the winners, and deliver the prizes. The legal basis is Art. 6 para. 1 lit. b GDPR. Data collected as part of the giveaway will not be used for further advertising purposes without a separate legal basis or, where required, separate consent.
Participants’ data will be deleted no later than 30 days after the giveaway ends, unless statutory retention or documentation obligations require otherwise. However, the comments on Instagram will remain and continue to be publicly visible.
The controller within the meaning of the GDPR is cardcosmos GmbH, Bremland 34, 24857 Fahrdorf.
The participant may withdraw their consent to the use of personal data at any time. The withdrawal must be submitted in writing to the address of cardcosmos GmbH stated in the legal notice. Following withdrawal of consent, the personal data collected and stored will be deleted immediately. Participation in the giveaway will then no longer be possible.
The organizer reserves the right to change the giveaway components without prior notice, cancel, or terminate the giveaway due to unforeseen circumstances. This applies in particular if errors occur in the software and/or hardware, and/or other technical and/or legal reasons affect or make impossible the regular and proper conduct of the giveaway.
Recourse to the courts is excluded. German law applies exclusively. Should any individual provision be or become invalid, the validity of the remaining terms and conditions shall remain unaffected. These terms and conditions may be amended by cardcosmos GmbH at any time without separate notification.
